I would assume that the fine will go to the Treasury. Unlikely to be ringfenced, though some of it will no doubt notionally offset the OFT’s future running costs, which are no doubt will be higher by having employed an army of consultants and lawyers to pursue such a complex case and no doubt others in the future. This is not the end of the story though - the OFT is also conducting a criminal investigation into whether any individuals dishonestly fixed the levels of the surcharges which is an offence under the Enterprise Act. Although unlikely, but we could yet see someone in jail!!BA's assertion that passengers had not been overcharged is fanciful. What’s would be the point in engaging in cartel behaviour unless otherwise?
